The DECO attempts lawsuit against Apple (Portugal)

After several attempts to secure the rights and economic interests of consumers, DECO has decided to proceed with a lawsuit against Apple because of misleading information on the site, coaxing consumers to buy the AppleCare Protection Plan (AppleCare Protection Plan).

Since last March DECO had denounced the deceptive practices relating to Apple's warranty period. Apple has, on the site, several ways to get information on consumer rights, but it provides on the legal guarantee is misleading.

When purchasing any goods, the consumer benefits from a two-year warranty. This applies to all defects that arise during this period. Apple reports misleadingly claiming that the guarantee applies only to defects that already exist at the time of delivery. Forget that the Portuguese law presumes that the defects that have two years after purchase already exist at the time of delivery.

When buying a defective product, the consumer can choose between repair, replacement, price reduction or cancellation of the contract. Apple, once again, reports misleadingly claiming that the consumer is entitled to repair and replace them. Ignores consumer rights against the seller and manufacturer.

If you buy an insurance policy or plan of protection for your laptop, for example, that purchase is only beneficial to extend the term of the legal guarantee of 2 years. Apple sells the AppleCare Protection Plan, which adds nothing to the legal guarantee and constitutes an unfair trade practice.

With this lawsuit, the DECO intends that consumers are properly informed about their rights and only acquire the products when they see them as a real added value. From Deco
